Terms & Conditions


Introduction

Jay3lle is a Swedish clothing company that has an online presence in EU.

The following terms & conditions apply to all purchases and deliveries of products from https://www.jay3lle.com/ (henceforth referred to as “Jay3lle” or ”We”) within EU, but do not effect the customers´statutory rights according to local legislation. 

The terms & conditions are continuously reviewed, and customers are therefore recommended to read them at the time of each purchase. The terms & conditions for a specific order are the once valid at the time when the order was placed. By placing an order the customer accept the current terms & conditions. 

 

Prices & delivery fees

All prices are in euro (€) and include the relevant VAT (value added tax). Prices include the cost of dispatch. The prices shown on the date when the customer places its order are valid through the whole purchase process.

Age limit

Customers with a minimum age of 18 and a residential address in a European country are able to buy products from https://www.jay3lle.com/.

Purchase

The purchase agreement applies when the customer receives the order confirmation via email from Jay3lle. A condition is that the customer leaves the correct details regarding email address, residential address, and phone number. The amount is reserved to the customer's card when the order is placed and the amount is being charged when the order is delivered. If a delivery cannot take place due to the products are not in stock this is indicated in your delivery confirmation, where the products are marked as not delivered.

Unfortunately, we cannot offer company purchases via our website. All orders must be placed by private individuals. This means that we cannot provide invoicing information for company purchases. Jay3lle reserves the right to cancel orders when the right of withdrawal/return policy is misused.

Payment

We accept credit card payments from [VISA and Mastercard]. In some countries local payment options are available.

 

Security of payments

For all card transactions SSL (Secure Socket Layer) applies and the transactions are being encrypted. We always check the card validity and that there are sufficient funds to cover the purchase amount. Jay3lle retains the right to refuse the card purchase. To ensure the customer’s security we cooperate with an authorized payment agent who handle the customer’s card details in a secure way. Jay3lle never saves information regarding your credit card. If a customer has any questions about the security of payments our recommendation is that they contact us through support@jay3lle.com.

Deliveries

We do not send partial deliveries. When the customer's order is delivered the amount is debited for the products that are sent. When the products have left our warehouse for delivery a delivery confirmation is sent by email. 

We cannot make any changes regarding the recipient or delivery address after the order has been created when placing the order.

 

Delivery times

Our aim is for customers to receive deliveries within [2 to 6] working days. The delivery time can, however, vary depending on the quantity of orders to be dispatched and circumstances that Jay3lle has no control over such as delays by the carrier.

If the products are damaged or lost during transportation to the customer, Jay3lle is responsible for payment, but you must notify our Customer Service within a reasonable time (within 2 months). In case the package has a visible damage, or If content is missing, we need to contact the carrier within 1-3 days of receipt and we are therefore grateful If you as a customer notify as soon as such a situation arises. 

If the products are damaged or lost when you return them, you are responsible for payment. 


Uncollected packages 

In case of non-collection, the customer will be charged 10 euro to cover the costs for freight.

Return of products

We apply a 15-day right of withdrawal that applies from the moment that you receive the delivery. The only condition is that the products are returned in their original state, unused and with all the labels attached. If the products are in a significantly altered condition this cannot be restored, a price reduction can be made up to 100% of the value of the products. You are responsible for any reduced value of the products if this is due to your handling of the products to a greater extent than is necessary to determine the nature, characteristics, and function of the products. If you wish to have the products returned, a freight cost of 10 euro may also be charged if you do not exchange the product for another size. 

If you withdrawal your purchase, you must notify Jay3lle. You can contact Jay3lle´s customer service to get assistance with complaints, right of withdrawal and other assistance issues related to a purchase or order. As a customer, you should include your name, address, and other relevant information such as the order number, invoice number and the name of the products in the message. You can also choose to exercise your right of withdrawal by sending a standard withdrawal form issued by your local Consumer Rights Authority.

To return the products please place the return label that was included in your package on the outside of the parcel. We care about our customers, and we would therefore be grateful if you took the time to include a note in the package with information about why you are returning the products.

When we have received and handled a return the value of the products is repaid, minus return freight of 10 euro (if no exchange of product), to the card that was used to make the purchase. If Jay3lle has sent a wrong or a defective product, Jay3lle will not charge the customer any freight costs. 

In the case of a complaint where we do not find a fault in the product, or if it is a fault caused by misuse, we may charge a fee of 5 euro to return the product to you or discard it free of charge. We promise to keep you updated as we process your complaint. We never charge a fee for an approved complaint.

Products that may not be returned are gift certificates, underwear, swimwear (where the plastic seal at the crotch has been removed), cosmetics and earrings. However, defective products may always be returned.

When returning shoes, the shoes must be returned in the original package in which they were delivered to you.

Note that returns must be sent to the address given on the return label.

 

Defective product

We apply the statutory guarantee rules for defective products. If a faulty product has been sent, the customer is requested to immediately submit a claim for obvious material or production faults on delivered products to Jay3lle – this also applies to damage incurred during transportation.

The right of complaint is valid for 3 years. The complaint does not apply to normal wear. If a defect is discovered the customer must inform Jay3lle within a reasonable time after the defect was discovered or should have been discovered if he or she wishes to make a complaint. Complaints made within two months of discovering the defect are always considered timely. If a customer does not complain in time, the right to complain is lost. A defect that becomes apparent within 6 months of the consumer taking possession of the product (usually the time of delivery) is presumed to have existed when the risk was transferred.

Reservations

Jay3lle accepts no liability for any mistakes in illustrations or text items. Jay3lle always follows the European Consumer Centers Network’s recommendations. 

 

Force majeure

During force majeure, Jay3lle´s obligations are suspended. If force majeure prevails for more than 2 months, both the customer and Jay3lle have the right to cancel the agreement without any obligations to pay damages. 

Force majeure includes, amongst other things, strikes, personnel sickness, transport disruptions, import/export bans, natural disasters and war irrespective of whether this occurs in the company or at the company’s suppliers.
